Welcome to www.ipu.ie (“the Website”), which is provided by the Irish Pharmacy Union (“IPU”). By using this Website, you agree to the following terms and conditions of use. The IPU reserves the right to amend the terms and conditions of the Website and will post these changes below. It is understood that by continuing to use the Website, you accept these changes.
If you do not accept these Terms and Conditions, please do not use the Website.
Member passwords and account security
The IPU supplies each member of the IPU (“Member”) with a username and password for the Website. If you are a Member, you agree and understand that you are responsible for maintaining the confidentiality of the password associated with your account. Information contained on the Members’ section of the website is strictly for use by IPU Members only.
The content of the pages of this Website is for your general information and use only. It does not constitute professional advice (including, without limitation, medical, legal and accountancy). Before making any decision or taking any action which might affect you in any manner, you should consult a qualified professional advisor.
The IPU makes no representations or warranties of any kind, express or implied, about the completeness, accuracy, quality, fitness for purpose, reliability, suitability or availability of the Website or the contents, information, products, services or related graphics contained on the Website (including without limitation any interactive areas) for any purpose or any of the information, content or material on any website referred to or accessed by hypertext link or otherwise through the Website or any third party advertisements contained on the Website. The IPU may take any remedy (including legal and technical) to prevent any breach or to enforce these Terms and Conditions.
Availability of the Website
Although we aim to offer all users the best service possible, we make no promises that the Website will meet all requirements all the time. Access to the Website is offered on an “as is” and “as available” basis only. We cannot guarantee that the Website will operate without fault. If a fault occurs with the Website, you should report it to Aoibheann@ipu.ie and we will attempt to correct the fault as soon as we reasonably can.
The Website contains links to other third party websites which are not under the control of the IPU. It is your responsibility to make your own decisions about the accuracy, currency and reliability of information contained in linked third party external websites. Links are provided for your convenience and inclusion of any link does not imply endorsement or approval of the linked third party website, its operator or its content by the IPU. The IPU is not responsible for the content of any third party website. If you decide to access linked third party websites, you do so at your own risk.
All intellectual property rights (including but not limited to trade marks, trade names, service marks, copyright, future copyright, registered or unregistered design rights; trade and/or business name; know-how; database rights and rights granted under licenses and consents; goodwill and reputation) in and relating to the Website (including but not limited to information, content, materials, programmes, designs, graphics, texts, layouts, screen icons, GUIs) shall remain and are the sole property of the IPU. You are not permitted to use such intellectual property rights unless expressly authorised in writing by the IPU or its licensors.
These Terms and Conditions, and all disputes and claims arising out of or in connection with them, and use of personal data shall be governed by and construed in accordance with Irish law.
Each party irrevocably agrees to submit to the exclusive jurisdiction of the Irish Courts as regards any claim or matter arising under or in connection with these Terms and Conditions.
In no event will the IPU be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, your use of (or inability to use) this Website; from any inaccurate or misleading information, content, advertisements or material contained on the Website; and any reliance on same is at your own risk.
The IPU also does not represent or warrant that the Website shall be free from inaccuracies or typographical errors. The IPU expressly excludes any warranty, representation or undertaking that you will be able to access or use the Website at times or locations of your choosing. The IPU does not represent or warrant that the Website will be free from any virus, worm or Trojan horse, or that the Website will be uninterrupted, secure or error free, or is compatible with any other software or material.
You agree to defend and indemnify the IPU, including its officers, directors and employees, servants and agents, against all liability, claims and expenses, including legal fees, arising out of any breach of these Terms and Conditions, use of the Website or violation of any law or rights of a third party by you and, if applicable, your officers, directors and employees, servants and agents.
The failure of the IPU at any time to enforce any provisions of these Terms and Conditions shall in no way affect its right thereafter to do so. Any waiver by the IPU of any breach of any term, provision or condition shall not be taken or held to be a waiver of any subsequent breach of any such term, provision or condition, or to be a waiver of the term, provision or condition itself.
Nothing herein shall be deemed to create any agency, partnership, joint venture, employee-employer or franchisor-franchisee relationship of any kind between the IPU and you, any third party or other person or entity.
If any court of competent jurisdiction decides that any part, term or provision of these Terms and Conditions are invalid or otherwise unenforceable, such provision shall be severed and deleted from these Terms and Conditions and the remainder of these Terms and Conditions shall continue to have force and effect.
