From January 1, 2023, the Sick Leave Act 2022 will come into effect. This legislation will bring Ireland in line with other European jurisdictions.
The purpose of the act is to provide sick pay to employees where no such scheme exists in their company. It sets a minimum floor of entitlement for employees who are unable to work due to illness or injury, thereby providing a minimum level of protection to employees, who may otherwise have no entitlement to a company sick pay scheme.
The Act sets out that employees will now be entitled to three statutory sick days per year from January 1, 2023.
The Act allows for the Minister to vary the number of statutory sick days and the maximum number of sick days payable are set to increase as follows:
– 2024 5 days
– 2025 7 days
– 2026 10 days
These days can be consecutive or non-consecutive.
